LEAD: BEYOND Phase 2 expands the partner list — not your ticket
Your next mapping job does not get a new beyond-visual-line-of-sight (BVLOS) path because FAA widened a government test program.
On August 27, 2026, FAA announced Phase 2 of BEYOND and said it will select up to eight additional state, local, tribal, or territorial entities as lead participants — enough, FAA says, to double the program’s current size. Phase 1 logged more than 70,000 flights, including more than 48,000 BVLOS operations. FAA says that operational and safety data informed its upcoming BVLOS rule and helped push regulation away from case-by-case approvals toward clearer performance-based standards.
What changed: more government lead participants feeding real-world ops into how FAA builds routine advanced drone work.
What did not: BVLOS authority for Part 107 pilots, survey crews, public-safety units, or enterprise flight leads outside the program. A BEYOND seat is a partnership lane for selected SLTT leads and their teams — not a blanket green light for every commercial small-UAS job. Keep flying under the authorization you actually hold — Part 107 plus any waiver or exemption on the card, Part 135 OpSpecs if you are on that certificate, or a COA if that is your lane — until a published pathway applies to you.

Part 108 — still pending at OIRA
Draft final rule RIN 2120-AL82 (Normalizing Unmanned Aircraft Systems Beyond Visual Line of Sight Operations) was received by OIRA on July 10, 2026. RegInfo still shows Pending EO 12866 Regulatory Review — not law. NPRM published August 7, 2025 (90 FR 38212; Docket FAA-2025-1908). Pending review is not Federal Register publication, not an effective date, and not permission to drop visual observers or rewrite a Part 107 CONOPS. If a client asks “is Part 108 out yet?” the accurate answer is still no — show them the OIRA pending record.

National drone-delivery PEA / FONSI — process, not permission
FAA signed a Finding of No Significant Impact / Record of Decision for a national Programmatic Environmental Assessment covering commercial drone package-delivery operations under Part 135 on July 28, 2026. Federal Register notice of availability published July 30, 2026. FAA says it intends to use the PEA when it reviews later operator authorization requests, and may still require project- or operation-specific NEPA work where more detailed analysis is needed. PEA / FONSI ≠ Part 135 certification, airspace authorization, BVLOS authority, or approval for a particular delivery route.
